Terms of Service

Welcome to E1 Book. These Terms of Service ("Terms") govern your access to and use of E1 Book, a service that automatically reads receipts and similar documents. By accessing or using E1 Book, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any applicable laws and regulations, including but not limited to the Australian Consumer Law (ACL), the Privacy Act 1988 (Cth), the General Data Protection Regulation (GDPR), and other international data protection and consumer rights regulations.

1. Definitions

  1. "E1 Book" refers to our mobile and/or web application, related services, software, platform, and technologies owned and operated by E1 Development.
  2. "User" refers to any individual or entity using E1 Book.
  3. "Content" refers to any text, images, receipts, documents, or data uploaded, processed, or stored using E1 Book.
  4. "Personal Data" means any information that relates to an identified or identifiable individual, as defined under applicable data protection laws.
  5. "Services" refers to the functionalities and features provided by E1 Book, including document processing, storage, and analysis.

2. User Accounts

2.1 Account Creation

  1. Users must create an account to access certain features of E1 Book.
  2. Users need to provide accurate, complete, and up-to-date information during registration.

2.2 Account Security

  1. Users are responsible for maintaining the confidentiality of their login credentials.
  2. Any unauthorized access or use of an account must be reported immediately to E1 Book support.
  3. E1 Book reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

3. Acceptable Use Policy

By using E1 Book, you agree to:

  1. Use the service only for lawful purposes and in compliance with all applicable laws and regulations.
  2. Not upload, process, or store any illegal, harmful, offensive, or fraudulent content.
  3. Not attempt to interfere with, disrupt, or harm the security and functionality of E1 Book.
  4. Not engage in data scraping, reverse engineering, or unauthorized data extraction.
  5. Not use E1 Book to store sensitive personal data, including but not limited to financial information, medical records, or government-issued identification numbers unless required for lawful purposes.

4. Data Privacy and Security

4.1 Collection and Use of Data

  1. E1 Book collects and processes user data in accordance with its Privacy Policy.
  2. By using E1 Book, you consent to the collection, storage, and processing of your data for service provision, analytics, and security purposes.

4.2 International Compliance

  1. E1 Book complies with the Australian Privacy Act 1988 (Cth) and the General Data Protection Regulation (GDPR) for users in the European Economic Area (EEA).
  2. Users may have rights under GDPR, including data access, correction, deletion, and portability.
  3. Users in California are entitled to protections under the California Consumer Privacy Act (CCPA).

4.3 Data Retention and Deletion

  1. User data is retained for as long as necessary to provide services, comply with legal obligations, and enforce agreements.
  2. Users may request deletion of their data, subject to legal retention requirements.

5. Subscription, Billing, and Payments

  1. Certain features of E1 Book may be available through a paid subscription.
  2. Subscription fees are charged on a recurring basis as per the selected plan.
  3. E1 Book reserves the right to modify pricing and billing terms with prior notice.
  4. Refunds may be issued at E1 Book's sole discretion, subject to consumer protection laws.
  5. Users in Australia have rights under the Australian Consumer Law (ACL) regarding faulty or misrepresented services.

6. Upgrade and Downgrade Subscription

6.1 Upgrade and Downgrade on Android

  1. Immediate Effect: When you upgrade or downgrade your subscription on Android, the change takes effect immediately upon purchase.
  2. Unused Subscription Time: The remaining time from your previous subscription will not be carried over to the new subscription period.
  3. Credit Adjustments: Any remaining credits from the previous subscription will be added to your new subscription. However, these credits will not exceed the maximum credits allowed for the new subscription plan.

6.2 Upgrade and Downgrade on iOS

  1. Upgrade Subscription: When upgrading on iOS, the new subscription will take effect immediately. The remaining time from your previous subscription will not be carried over.
  2. Downgrade Subscription: If you downgrade your subscription, the new plan will take effect once your current subscription period ends.
  3. Credit Adjustments: Any unused credits from your previous subscription will be added to your new plan, but the total credits will not exceed the maximum credits for your downgraded subscription.

7. Intellectual Property Rights

  1. E1 Book and all associated software, trademarks, and content are the intellectual property of E1 Development.
  2. Users are granted a limited, non-exclusive, revocable license to use the service for personal or business purposes.
  3. Users may not copy, modify, distribute, or sell any part of E1 Book without explicit permission.

8. Disclaimer of Warranties and Liability

  1. E1 Book is provided "as is" and "as available" without warranties of any kind, either express or implied.
  2. E1 Book does not guarantee the accuracy, completeness, or reliability of processed data.
  3. Users assume all risks associated with using E1 Book.
  4. To the maximum extent permitted by law, E1 Book shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the service.

9. Termination and Suspension

  1. E1 Book may terminate or suspend user accounts for violations of these Terms.
  2. Users may discontinue the service at any time by deleting their accounts.
  3. Termination of an account does not relieve the user of any outstanding obligations.

10. Dispute Resolution

  1. In the event of a dispute, users agree to attempt resolution through informal negotiation before seeking legal remedies.
  2. Users in Australia may seek remedies through the Australian Competition and Consumer Commission (ACCC).
  3. Users in the EEA have rights under GDPR to file complaints with their local data protection authority.

11. Changes to These Terms

  1. E1 Book reserves the right to update or modify these Terms at any time.
  2. Users will be notified of significant changes via email or in-app notifications.
  3. Continued use of E1 Book after changes take effect constitutes acceptance of the updated Terms.
